As it was to be expected
Turkey's press has finally picked up on the appalling situation
created by the Istanbul Metropolitan Municipality's and the Head of
the Veterinary Department, Arif Irfan Eker.
This weekend two of the leading newspapers in Turkey, Milliyet and
Hurriyet have exposed the issue in their pages.
This fight will continue in the Administrative Court as well as in
the Mass Media. Sooner or later the Istanbul Metropolitan
Municipality will come to realize that it is much easier,
cost-effective and certainly better for PR purposes to manage
Neuter and Return in a humane and professional way, and counting
with our collaboration and supervision that leaving the whole
responsibility of this crucial project under the control of
companies and individuals of dubious repute.
The moment there is a firm commitment on the part of the Istanbul
Metropolitan Municipality to make this project work in strict
accordance with the Law, and guided by Humane Principles, we,
EHDKD, as well as our friends of the Society for the Protection of
Stray Animals, will be there to lend them a helping hand towards
its successful completion.
Until then the fight will continue both in the Court as well as the
public forum of national and international Media. It is up to Arif
Eker and ultimately up to Kadir Topbas, the Major of Istanbul to
decide which route to follow: a new way guided by humanity,
legality and joint cooperation OR its current inhumane, illegal and
dismissive behavior that is ending with the lifes of thousands of
animals in an appalling display of animal cruelty and total
disregard of both Law and public opinion.

The Sariyer Kocatas
Shelter, belonging to the Istanbul Metropolitan Municipality is at
the center of a controversy that is now in the hands of the
Administrive Court. EHDKD has been working voluntarily at the
shelter for six years but was told by the Istanbul Municipality
Veterinary Department, to leave the place in August. The director
of EHDKD, Deniz Bingol told us the following:
“We were told to leave the shelter because Istanbul Municipality
Veterinary Department opened a tender and gave the job of neutering
of dogs to a firm. We were told that this firm would be working at
Sariyer. First we were happy that the neutering would be done by a
professional firm. But then we found out that the firm which was
given the duty, was a pesticide firm. This made us have some doubts
about the issue. After September, we started receiving photographs
from the shelter; dogs were caught by men who had no experience in
the job, they were operated by inexperienced vets in unsuitable
conditions, post operative treatment was not given and dogs were
dying either at the operation table or immediately after. These
practices are against the Animal Protection Law and the technical
regulations of the tender. Furthermore, most of the dogs were
thrown into forests and in rabies quarantine areas. Our efforts to
deliver these documents and information to the municipality were
futile.”
Now the case is in front of the Administrative Court.

action!

In an effort to support
our landmark courtcase against the Istanbul Municipality with an
across-the-board education effort today EHDKD started the shooting
of a documentary that aims to explain the origins and causes of the
plea of the stray dogs of Turkey as well as the only viable
solution, the implementation of a nation-wide campaign of Neuter
and Return.
This documentary will be the first of a series and, hopefully, the
beginning of a broader initiative aiming to educate the turkish
population on animal wellfare issues.
The only way forward is a combination of education activities and
legal action that ensures the correct implementation of the Animal
Wellfare Law. We are facing strong opposition from the
"usual
suspects" but with intelligence
and determination we will contribute to a lasting and permanent
change of the sad situation we witness today in this country.

Execution
suspended!!!

Execution of Neuter and
Release carried on by Anadolu Ilaç in three shelters of Istanbul
Municipality at Tuzla, Alibeykoy and Sariyer has been suspended by
Istanbul Municipality.
The fact that Istanbul Municipality Veterinary Department has
ceased the execution doesn't exempt them from the responsibility of
the crimes in the past.
The court is to decide about the subject.
We will inform you about further developments.

An inhumane act -

Do
you see that white tag in the puppy's ear?
That is the white tag
of the Buyuksehir Belediye and Anadolu Ilac.
The age of that puppy
could not be more than three to four months old. He, too, is one of
the many hundreds dropped by Anadolu Ilac in the forests and roads
surrounding Istanbul.

Many
of those dogs are dying as we speak... others will die in the very
near future, either of hunger or being run over by cars.. the point
is... those dogs should not be there in the first place. It is
barbarian and inhuman to drop them in such a way in the forests and
roads, where there is no food and they stand very little chance for
survival.

Telling the
World

We
are currently in the midst of launching a widespread national and
international media and communications campaign aiming to educate
the Turkish population about the problem of the stray and abandoned
animals as well as informing the international community of the
progress of Turkey in animal wellfare matters.
We are also aiming
to make the Istanbul Municipality understand that it is in their
interest, politically and economically to properly implement the
Neuter and Return project IN COOPERATION with experienced animal
wellfare organizations. As long as Arif Eker and the people
responsible refuse to accept that fact, and entrench themselves in
a position of denial and covering up the fact that they are
operating dogs and dropping them by the side of the road or in the
middle of the forest so they are crushed by cars or starve to
death, there will be not one, but a thousand court cases against
them, and in the end, the people responsible will stop being an
asset but will become a liability.
... and we all know what happens
in politics when someone becomes a liability.

The
Municipality must understand that this is a national problem, and
one that it is in the best interest to solve in a Humane, Efficient
and Permanent manner.
So far it is a failure but we are still
hopeful. One must never loose hope in humanity.

We were informed that Corum Municapality poisoned&killed stray
dogs in Corum and related photos are attached in the

Turkish Animal Protection Law Number 5199
Purpose
ARTICLE 1 – The purpose of this law is to ensure that animals are
afforded a comfortable life and receive good and proper treatment,
to protect them in the best manner possible from the infliction of
pain, suffering and torture, and to prevent all types of cruel
treatment.
Scope
ARTICLE 2 – This Law includes the regulations to be made in line
with the purpose article, the precautions to be taken, the
coordination, supervision, restrictions and obligations to be
imposed and the penal provisions to be enforced.
Principles
ARTICLE 4
a) All animals are born equal and have a right to life within the
framework of the provisions of this Law.
Protection of ownerless and incapacitated animals
ARTICLE 6- It is forbidden to kill ownerless or incapacitated
animals, apart from the situations set forth in the Animal Health
Police Law no. 3285.
Ownerless and incapacitated animals must be brought as quickly as
possible to animal shelters established or permitted by the local
authorities. These animals will first be held in the observation
areas established in these centres. It is a principle that animals
that have been sterilised, vaccinated and rehabilitated will be
registered and released into the environment that they were taken
from.
Bans
ARTICLE 14 – The following actions in relation to animals are
banned:
a) To intentionally mistreat animals, to carry out a cruel and
unfair action, to beat an animal, leave them hungry or thirsty, to
abandon them in extreme heat or cold, to neglect their care or to
cause them physical and psychological pain.
Killing of animals
ARTICLE 13 – It is forbidden to kill animals unless there are legal
exceptions or in case of a medical or scientific necessity; and
when there is no food purpose or threat to humans or the
environment, pregnant, nursing, and birthing animals may not be
killed.
Everyday, from all over the country, we hear about municipalities
mass killing dogs. The petitions regarding the issue are not
handled seriously by the authorities, no relevant reply is given
and no solution is proposed. The municipalities insist on ignoring
the Act no 5199 and its binding duties, and continue the slaughter.
The Ministry of Interior responsible for inspection and
administration of the issue neglects its duties as well.
Turkish Animal Protection Law number 5199 is completely ignored by
the municipality in Corum and by the Ministry of Interior
responsible for inspecting the municipalities.
We will send these inhumane photos to the EU Member States, and
tell them that the non-ethical mass killing of stray animals by
municipalities continue increasingly, even after the signing of the
Animal Protection Act no 5199.
We kindly ask you to take action in The Grand National Assembly of
Turkey for providing the implementation of Act no 5199, and expect
you to call Abdulkadir Aksu – the Minister of Interior on duty with
an interpellation, should the occasion arise.

Pain, cruelty in a
shelter in Turkey
The slide show you are going to watch was recorded on Sept 15,
2006, at
Sariyer Kocatas shelter. The Sariyer Shelter is run by AIG, a
sub-contractor of Biosav that was given the job of neuter and
release in
Istanbul by the Istanbul Metropolitan Municipality as a result of a
legal
tender.
We present these scenes to you and would kindly ask you to follow

Background
information:
As
written about before on our website, the June 2004 law stipulating
that neuter and release is the only permitted method of solving the
stray dog issue was put into effect since July. The boroughs are
obliged to handle the problem and to have a good pound where the
neutered dogs can recover. The animals have to be registered and
returned to their original surroundings.
Because the
municipalities cannot organize all this by themselves, they have
called for tenders. For a part of Istanbul the work was contracted
out to a pesticide company. You can see how these people handle
things in the slideshow we will direct you to later.
The situation is
abominable. A lot of dogs die and sick dogs are just turned back on
the streets. Cases are known of a mother dog that was captured to
be sterilized when she was already giving birth. The dog was thrown
out of a car into a kennel and mother and pups have all died. A dog
with a hernia was sterilized and returned to the streets, the same
was done to a dog with a broken hipbone.
Also, there are no
records of where the dogs were picked up, so they are just put on
the streets anywhere; this causes a lot of
fights.
The hygiene in the
pounds where the dogs are being sterilized/neutered is very bad,
the way the dogs are being caught looks like animal abuse, and the
transport is being done in cars without any ventilation, with cargo
space temperatures ranging from 38 to 50 C.
Volunteer groups that
were working in the pounds are turned out on the street; the same
happened to some of the ‘residents’ of a particular pound. These
dogs are now wandering around the pound with no water or
food.
Today people from the
EDHKD and SHKD made pictures that can serve as evidence. It’s just
too awful to think what might happen to the tens of thousands of
dogs that are still in the pounds.
